Constitutional Complaint arbitrary act by Zurich`s judges/ subsidiäre Verfassungsbeschwerde Willkür bei Züricher Oberrichtern

 

The Constitutional Complaint - filed December 12th, 2011, is based on a verdict of the Federal Court of Switzerland of March 7th, 2011 against an arbitrary decision of the three judges of the High Court of Zurich Kurt Balmer (SVP), Willy Meyer (SVP) and Anton Schärer (Grüne). The three judges of the High Court felt that it is sufficient based on a written complaint filed by the victims to interrogate only the accused parties. They also felt it is not necessary to question neither the victims nor witnesses even though written testimonies were provided by victims and witnesses about the harassment. It appears that it is an act of wilful blindness and it is even an act of "if you cannot destroy the evidence then beat the witness and ignore all evidence" in order to protect the suspects or better the might-be offenders. The three judges of the High Court of Zurich have been protected by the Office of the State of Zurich (Geschäftsstelle des Kantonsrats) which not only deals with the complaint but represents the electing  body "Kantonsrat" of the three judges of the High Court. This goes without saying simply against the principle of separation of power in a democratic state like the state of Zurich claims to be. Anyhow, the Federal Court accepted the filing of the complaint late December 2011. If you read the complaint in detail you will notice that the Office of the State of Zurich jumped to a conclusion for whatever reason! In law, malpractice is a type of negligence in, which the professional under a duty to act, fails to follow generally accepted professional standards, and that breach of duty is the proximate cause of injury to a plaintiff who suffers harm. It is committed by a professional or her/his subordinates or agents on behalf of a client or patient that causes damages to the client or patient.

Die beigelegte subsidiäre Verfassungsbeschwerde, eingereicht 12. Dezember 2011, basiert auf einem Urteil des Bundesgerichts vom 7. März 2011. Das Bundesgericht erteilt mit diesem Urteil den drei Oberrichtern Kurt Balmer (SVP), Willy Meyer (SVP) und Anton Schärer (Grüne) eine Willkürrüge, weil man singesmäss weder die Opfer noch Zeugen und nur die Beschuldigten befragte, obwohl eindeutige Hinweise und schriftliche Bestätigungen vorlagen, dass ein widerrechtliches Vorgehen der Beschuldigten mit einer grosser Wahrscheinlichkeit bestehe. Die Geschäftsstelle des Kantonsrats Zürich entschied: es sei trotz Willkürrüge des Bundesgerichts nicht genügend nachgewiesen, dass ein widerrechtliches Vorgehen der Richter vorliege und damit keine Untersuchung betreffend den Oberrichtern stattfinden soll. Zur Information der Kantonsrat Zürich wählt die Oberrichter und kontrolliert die Oberrichter ebenfalls und ist folglich damit Partei. Es handelt sich deshalb nicht um eine unabhängigen Entscheid. Die Gewaltentrennung wie dies in einem demokratischen Rechtsstaat üblich ist, liegt hier in diesem Fall nicht vor. Analysiert man den Sachverhalt genau, dann kommt man zudem zum Schluss, dass die Geschäftsstelle voreilig entschieden hatte.

 

Amtswillkür oder auch Amtsdelikt bezeichnet einen Akt der Willkür durch einen meist beamteten Amtsträger in einer Behörde.


Der Träger eines öffentlichen Amtes ist wegen seiner besonderen Macht- und Vertrauensstellung zur unparteiischen Wahrnehmung der ihm übertragenen hoheitlichen und öffentlich-rechtlichen Aufgaben verpflichtet. Ihm obliegt eine besondere Sorgfalts- und Neutralitätspflicht. Entsprechend dieser regelmäßigen beruflichen Aufgabe von Amtsträgern im Sinne der öffentlichen und rechtlichen Ordnung ergibt sich eine besondere Gefährdung für Handlungen, die im rechtlichen Sinn in einem weiten Spektrum von der Fahrlässigkeit bis zur Selbstjustiz liegen können (Wikipedia).
